Posted in : First Tuesday Q&A NI on 2 February 2010 Issues covered:It is often a source of frustration to employers that, almost whatever the circumstances of termination of employment, the employee is entitled under the Working Time Regulations (WTR) to be paid in lieu of accrued, but untaken, holiday. It is the one exception to the overriding purpose of the WTR - to ensure employees take paid holiday. Employers often ask if they can require a worker who is serving out their notice period to take unused holiday. This would avoid having to make a payment for unused holiday on termination, and can be a useful means of obliging an employee to stay away from work at a sensitive time.
