Background:
The issue in this case related to the decision of the Industrial Tribunal that the claimant was not disabled for the purposes of the Disability Discrimination Act 1995. As a result of that finding, the Tribunal found that they did not have jurisdiction.
It was agreed by the experts that the claimant had a long-standing generalised anxiety disorder but the main element related to autism spectrum disorder. The claimant states there were aspects in which his memory or ability to concentrate learn or understand were affected, taking part in normal social interaction and forming social relationships.
