Do you have clients who are worried about how they might perform at a tribunal? Are they worried about what they might have to face when they get to Killymeal House or one of the outlying courthouses? Why not encourage them to increase their knowledge and reduce their fears in a safe, yet realistic, environment?
What are the Workshop Objectives?
Delegates will gain confidence from observing or taking part in a mock tribunal case, chaired by an experienced tribunal Chairman. The morning sessions allow delegates to prepare for the 'live' afternoon sessions, by studying 'real' applications and response forms and many background papers, with the support of experts.
All delegates will receive a full ‘bundle’ of documents, including ET1, witness statements, minutes from relevant meetings and internal hearings etc. They will work through the documents as the day progresses, via a mock conciliation meeting, towards the mock hearing. Some, under oath, will read out statements and will be subject to cross-examination from the ‘opposition’ representative and questions from the panel, chaired by Martin O’Brien BL, whilst the others watch. The tension at last year’s ‘hearing’ was palpable.
This will be the closest thing your clients could get to a tribunal without actually being in a formal hearing. It won’t dispel all the nerves if they have to face the real thing but it will dispel the myths and give witnesses a realistic insight into the workings of industrial tribunals.
Workshop Overview
* Note: Employers will be guided by an ex-industrial tribunal Chairman, Martin O'Brien; employment lawyer, Orlagh O'Neill; and Maxine Murphy-Higgins, a senior manager from the Labour Relations Agency, but some may be asked to volunteer for roleplaying parts. The bulk of the afternoon will be taken up by the mock tribunal hearing.
