To help with this process we have organised a free briefing seminar for our customers. It doesn’t matter whether you are in human resources, a trade union or a lawyer – this consultation exercise will affect you.

Legal-Island, in conjunction with the Belfast Telegraph, Deloitte, Tughans and Alexander HR will be hosting a FREE two hour seminar on the DEL consultation process on 30 June, from 9a.m. at the Holiday Inn, Ormeau Avenue, Belfast.

The first hour will focus on three main categories – dispute resolution, training needs and legal changes. After a refreshment break we will host a feedback plenary session until 11.00 am for all delegates.

Why should I attend this free seminar?

The Department of Employment and Learning (DEL) has issued a 90 page consultation document seeking the public's views on a range of proposals for change to systems for resolving employment disputes. But this consultation document goes much further than just the possible repeal of the dreaded 123 statutory grievance and dismissal procedures.

  1. Mediation and ADR Options led by Alexander HR; OR
  2. Legal Remedies and Structures (including the Rights Commissioner-style option) led by Tughans; OR
  3. Competences and Training Requirements of Managers (including the workplace accreditation option in the report) led by Deloitte

10.00 am Coffee and Networking

10.20 am Feedback Plenary Session and Debate

11.00 am Close


Areas for discussion include:

Employment Relations:

  • A revision of the role of the LRA
  • Company accreditation associated with employment relations best practice
  • Inspection/enforcement machinery
  • Retention or modification of the 123 procedures
  • Is some form of early neutral evaluation desirable and, if so, how should the process work?

Legal Remedies:

  • Incorporation within the existing system of a process comparable to Rights Commissioner hearings in the Republic of Ireland
  • Tribunal powers to penalise unreasonable behaviour relating to alternative disputes resolution
  • Should a tribunal's powers to award costs be extended?
  • Should tribunals be given statutory contempt powers?
  • Would the introduction of an Employment Appeal Tribunal be an improvement upon the current structure?

And that's just a flavour of what DEL wants you to comment on. This is a BIG consultation process. In fact, we can't think of a bigger or wider-ranging consultation process in the employment field.

So, we could have something similar to GB or something radically different. That's the beauty of devolution. People in the employment field – HR professionals, trade unions, employment lawyers and other interested parties have an opportunity to shape the employment relations agenda for years to come.

Written papers for this seminar will be made available to delegates via email links after the event, although printed copies of the consultation document will be given to delegates, courtesy of DEL.
