Session 1 Good Practice in Relation to Admissions - This requires you to be fair objective and reasonable but what exactly does thisallow you to do? Areas covered include :

  • What information can you ask for from parents/primary schools?
  • Application of Department Guidance.
  • Weighting of applicable criteria.
  • Children who do not sit entrance exams.
  • The extent of your duties to children with special educational needs.
  • Appeals/Challenges to admissions.

Session 2 Legal Issues Relating to Conduct, Suspensions and Expulsion
Areas covered include :

  • Sanctions available to schools.
  • The Law Relating to Restraint and Assault.
  • Features of a correct suspension and expulsion policy and procedure.
  • Rights of appeal against suspension and expulsion.
  • Panel Discussion & Consideration of Three Scenarios

Session 3 Judicial Review - understanding the role of judicial review in the education sector and practical implications of legal challenges through the Courts.

Legal Introduction to this complex area followed by consideration of scenarios explored by our expert panel including Child Protection Agency, Lawyer and School Principal.

Conference Chairman -

Jim McBain is the Northern Ireland Regional Officer for the Association of School and College Leaders (ASCL). Prior to his retirement in 2006 he was Principal of Omagh Academy Grammar School.

Speakers/Panel Members -

Eddie McArdle is Registrar and Chief Executive of the General Teaching Council, he has spent 35 years in the education service.

Frank Cassidy is Principal of St Louis Grammar School Ballymena. He is currently President of The ASCL.

Willa Mawhinney is currently Head of Compliance with Allianz in Ireland and has been working in consumer regulation since 2003.

O'Reilly Stewart Legal Team -

Seamus McGranaghan qualified as a Solicitor in O'Reilly Stewart Solicitors in 2003 and practices mainly in the areas of education and employment law. Seamus has assisted and advised many Boards of Governors, Senior Management Teams and Teachers in relation to all aspects of education and employment law. He has recently advised a number of Schools on the Transfer 2010 Guidance published by the Department of Education for Northern Ireland.

Joe Moore has been the managing partner at O'Reilly Stewart since 2004. A qualified solicitor advocate, he specialises in complex high court litigation cases.

Linus Murray qualified joined O'Reilly Stewart in 1999 and became a Partner in 2001. He heads up the Commercial Department and has assisted in the development of the firm's education practice which has resulted in the firm becoming the leading education specialists in Northern Ireland.
